In this Terms of Use document, the USER of the institutional site of Rivool Finance will find information about the operation of the portal and the internal rules applicable to the service. The document includes the legal bases related to the activities carried out to provide the service; the responsibilities of the USER when using the site; the obligations of Rivool Finance as a service provider; contact information and user service portal in case of questions or complaints about issues related to these Terms of Use and service provision.
1. ACCEPTANCE OF TERMS OF USE
This institutional site constitutes a legal agreement between the USER and SMART SOFTWARE LTDA, a private legal entity, registered under CNPJ number 49.261.619/0001-49, headquartered at Rodovia José Carlos Daux, no 5500, Shop 31, Tower Jurerê, Saco Grande, Florianópolis/SC, hereinafter referred to as "Rivool Finance", for the purpose of freely making available the company's institutional portal.
By using the site, the USER will be bound by this Term of Use, undertaking to comply with all its provisions, especially with regard to the authorization for access, use, collection, processing, storage, and methods of protecting the USER's information by Rivool Finance, necessary to enable the operation of the portal's features.
2. CONCEPTS AND DEFINITIONS
Rivool Finance: Company developing and providing the services of the site.
USER: An individual who is using the site.
SITE: Website developed for the dissemination of content and updates to USERS, subject of this Term - rivool.finance.
TERMS OF USE: Document that governs the use of the site and the responsibility of the involved parties.
3. SERVICE DESCRIPTION
With the goal of presenting Rivool Finance's tokenisation software to partners and investors, Rivool Finance provides the rivool.finance site, which allows the USER to understand the services to be offered by the software, to register to become a partner or investor in the business, and the means of contact with the company.
4. USER RESPONSIBILITIES
The USER of Rivool Finance's site is responsible for the repair of damages caused directly or indirectly to third parties and the company as a result of the violation of rights of secrecy, intellectual property, personality, and others of the same nature. This includes non-compliance with the contractual provisions stipulated in these Terms of Use and any act committed, from the provision of the service, that violates the intellectual property of Rivool Finance.
The USER of the institutional site of Rivool Finance agrees to:
1. Assume full responsibility for the misuse of the services used and, in particular, though not exclusively, responsibility for acts, damages, and losses that may arise from non-compliance with the law, generally accepted good customs, or public order.
2. Not reproduce the used site, either wholly or partially, including any possible adaptations, modifications, or incorporations into another program(s).
3. In the event that the USER develops a new site that is characterized as a copy, whether total or partial, its ownership will transfer to Rivool Finance, and its use will be subject to the same conditions of this Term.
4. Not to use the site in any way that may incur infringement, unlawful act, violation of rights, or damage to Rivool Finance or third parties.
5. When accessing links to other sites, the USER should check the respective Terms of Use used by these sites.
6. Provide true and correct data when filling in their information in the site's forms, taking responsibility for any typing errors.
5. RESPONSIBILITIES OF RIVOOL FINANCE
Rivool Finance, the holder of the intellectual property rights of the site rivool.finance, commits to implementing measures that protect the privacy and data protection of the portal's USERS. The company ensures that it employs information security measures to protect the data stored as a result of the service provision and commits to processing the data only for the purposes specified in this document. Rivool Finance undertakes not to disclose the information of the USERS, being the exclusive holder of the copyrights, development, and distribution rights of the site worldwide.
However, Rivool Finance is not responsible for the following facts:
1. Instability of the equipment, infection or invasion by viruses or malware, or installation of malicious codes;
2. Equipment damaged at the time of service consumption;
3. Protection of the equipment (mobile or desktop);
4. Protection of the information stored locally or in clouds owned by the USER;
5. Abuse of use of the USERS' equipment;
6. Clandestine monitoring of the USERS' equipment;
7. Vulnerabilities or instabilities existing in the USERS' systems;
